33 Bikers Fight Gag Order in Waco Biker Shooting

Thirty-three bikers are asking that a gag order imposed in a case connected to a Texas shootout in which nine bikers were killed be lifted.

The bikers filed a "friend of the court" brief Friday in support of the motion filed by an attorney for Matthew Clendennen, the only person among 177 arrested after the shooting who has filed a lawsuit.

Nine people were killed and 20 injured in the May shootout authorities say arose from a confrontation between motorcycle clubs.

The gag order issued in Clendennen's criminal case in June prevents anyone involved from discussing it with media.

The bikers' brief argues the order has been violated by the McLennan County district attorney and that free speech is the accused's only hope for a fair and impartial trial.
